Guide to the Irish Immigration System

Ireland is one of the most attractive global locations for foreign direct investment. The 2008 Index of Economic Freedom (Heritage Foundation) ranked Ireland 3rd out of 162 countries and one of the world’s most pro-business environments for foreign businesses/ investment. Here’s why:

· Corporation tax is the lowest in Europe at 12.5%

· Double tax agreements with over 45 countries plus tax incentives in R&D

· Viable base to access the EU/ EMEA market.

· Democratic and stable State, an attractive and safe place.

· Young, educated work force.

Our immigration system has developed rapidly to facilitate Ireland’s commitment to foreign businesses. Non EU/EEA Personnel entering employment require an employment permit. Here’s a brief guide:

Green Cards

· Annual gross basic over €59,999. In skills shortage areas lowered to €30,000.

· Employee salaried and taxed in Ireland.

· Employee holds a recognised professional qualification relevant to the job.

· Initial permit validity of 24 months.

ICT Permits

· Min’ annual gross basic of €40,000.

· Employee salaried and taxed in Ireland or the US.

· Employee has a min’ of 12 months employment with the overseas branch prior to transfer.

· Employee meets the professional criteria associated with the transfer.

· Foreign branch must be bona fide, and engaged in substantial business with a clear link to the Irish branch.

· Initial permit validity of up to 24 months thereafter renewable up to 36 months.

Work Permits

· Annual gross basic in excess of €30,000.

· Must have the requisite skills, experience and qualifications for the job.

· The employer must have undergone the statutory labour test of 8 weeks.

· Initial permit validity of up to 24 months thereafter renewable up to 36 months

 

Spouses/ Dependents of Employment Permits Holders:

· Are given a Stamp 3 allowing residence.

· Dependants of Green Card holders may apply for a Spousal / Dependent Permit.

 

De Facto Relationships / Marriage to EU Nationals:

 · De Facto Stamp 4’s are issued to those in relationships of 2 years duration with an Irish national. They negate the need for an employment permit.

 · EU Treaty Rights Stamp 4’s are issued to spouses/ partners of EU citizens under worker mobility rights. They negate the need for an employment permit
